We need ‘Same Job Same Pay’ laws for labour hire workers to take away the economic incentive for employers like big mining companies to outsource jobs that should be permanently and directly employed. Mining companies are deliberately shifting workers outside of the coverage of union negotiated enterprise agreements, which have improved wages and conditions above the Award minimum over many rounds of collective bargaining. Labour hire companies are able to tender for work on hourly rates well below that received by permanent employees. The substantial pay difference between labour hire and permanent employees also undermines casual conversion provisions. Labour hire employees rely on the casual loading to get them closer to industry standard pay rates. Workers shouldn’t have to trade off all their leave, entitlements and job security to receive a decent hourly rate.
